Terms of Service - Just Walk

1. Acceptance of Terms

By downloading, installing, or using the Just Walk application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and On World Tech LLC ("we", "our", or "us").

2. Description of Service

Just Walk is a health and fitness application that helps users build a walking habit by:

Tracking daily steps via Apple HealthKit
Maintaining walking streaks and goals
Providing guided walking workouts
Offering streak protection through shields

The App is available in both a free version and a premium subscription version ("Just Walk Pro").

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

By using the App, you represent that you meet these eligibility requirements.

4. Account and Device

Just Walk does not require account creation. The App operates using data stored locally on your device and accessed through Apple HealthKit.

You are responsible for maintaining the security of your device and any access to the App.

5. Subscriptions and Payments

5.1 Just Walk Pro

Just Walk Pro is available as:

Monthly Subscription: $4.99 USD per month
Annual Subscription: $29.99 USD per year

Both subscription options include a 7-day free trial for new subscribers.

5.2 Billing

All payments are processed by Apple through your App Store account. By subscribing, you agree to Apple's terms for in-app purchases and subscriptions.

Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.

5.3 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

5.4 Price Changes

We reserve the right to change subscription prices. Price changes will not affect your current subscription period but may apply upon renewal. Apple will notify you of any price changes.

5.5 Refunds

Refund requests are handled by Apple according to their refund policies. We do not process refunds directly.

6. Acceptable Use

You agree to use the App only for its intended purpose of tracking and encouraging walking activity. You agree not to:

Attempt to reverse engineer, decompile, or disassemble the App
Circumvent any security features or access restrictions
Use the App in any way that violates applicable laws
Attempt to manipulate or falsify health data
Redistribute, sublicense, or resell the App

7. Health Disclaimer

IMPORTANT: Just Walk is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App provides general fitness information and tracking. It should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult a healthcare provider before starting any exercise program
Heart rate data (in Fat Burn Zone) is for informational purposes only and may not be accurate
Stop exercising immediately if you experience pain, dizziness, or discomfort
Do not rely on the App for medical decisions

By using the App, you acknowledge that you are voluntarily participating in physical activity and assume all associated risks.

8. AI-Powered Nutritional Estimates

Just Walk includes an optional feature that uses artificial intelligence to estimate the nutritional content of foods based on your descriptions. By using this feature, you acknowledge and agree to the following:

8.1 Estimates Are Approximate

AI-generated nutritional estimates are approximations based on general food databases and AI interpretation of your descriptions. Actual nutritional values may vary based on:

Specific ingredients and brands used
Portion sizes and preparation methods
Regional variations in food composition
The specificity of your food description

8.2 Not Medical or Dietary Advice

The nutritional estimates provided by this App do not constitute medical advice, dietary counseling, or nutritional guidance from a licensed professional. These estimates are provided for general informational and tracking purposes only.

8.3 Consult Healthcare Providers

If you have a medical condition that requires precise nutritional monitoring (including but not limited to diabetes, kidney disease, food allergies, or eating disorders), consult with a qualified healthcare provider, registered dietitian, or nutritionist. Do not rely solely on AI-generated estimates for managing medical conditions.

8.4 No Warranty of Accuracy

We provide AI nutritional estimates on an "as is" basis and make no warranties, express or implied, regarding the accuracy, completeness, or reliability of these estimates. We are not liable for any decisions made or actions taken based on AI-generated nutritional information.

8.5 Third-Party Services

The AI food logging feature uses Google's Gemini API. Your use of this feature is also subject to Google's Terms of Service. We are not responsible for the availability, accuracy, or performance of third-party AI services.

8.6 Modifications

We reserve the right to modify, suspend, or discontinue the AI food logging feature at any time without notice.

9. Intellectual Property

The App, including its design, features, content, and code, is owned by On World Tech LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy of health or fitness data

We do not guarantee that the App will meet your specific requirements or expectations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ON WORLD TECH LLC SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of data, profits, or goodwill
Any personal injury or health outcomes related to use of the App
Any damages resulting from unauthorized access to your data

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless On World Tech LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, for any reason, without notice.

You may terminate your use of the App at any time by deleting it from your device and cancelling any active subscriptions.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or by posting updated Terms on our website.

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in California.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
